Falling behind on your mortgage is frightening, but repossession is usually the last step a lender takes, not the first — and there are several ways to stop or delay it. The worst thing you can do is ignore the letters. The earlier you act, the more choices you keep.

First: talk to your lender

Lenders would generally rather keep you in the home than repossess — repossession is slow and expensive for them too. Under the rules they must treat you fairly and consider alternatives before going to court. Ask about:

  • A temporary payment arrangement or reduced payments while you get back on your feet.
  • Adding the arrears to the loan (capitalising them).
  • Extending the mortgage term to lower monthly payments.
  • A switch to interest-only for a period.

Put everything in writing and keep a record.

How the repossession process actually works

Knowing the timeline helps you see how much room you have:

  1. Missed payments — the lender contacts you about the arrears.
  2. Default notice — a formal letter once arrears build up.
  3. Court claim — the lender applies for a possession order. You get a hearing date.
  4. The hearing — a judge can adjourn, suspend the order if you propose a realistic plan, or grant it.
  5. Possession order — even then, you can ask the court to suspend it. Eviction only happens after a warrant.

There is usually time to act at every stage — including selling the property to clear the debt before eviction but the best time to act is as early as possible to give you the most available options.


How a fast sale can stop repossession

If keeping the house isn’t realistic, selling before the court forces a sale is almost always better for you: you stay in control and a completed sale clears the mortgage and stops the legal action. A repossession sale by the lender, by contrast, is aimed at recovering their money first — not at getting you the best price. And, worst case, if the forced-sale doesn’t recover all of the debt, then the lender will continue to pressure you long after the property has sold.
